Isn't it enough to remove all art from wootch? If Nergal somehow manages to pull this off, he could move the whole Urban X Life fanbase to his site and get more traffic for his other projects.

Even if every original art is removed, wootch still owns the IP (Intellectual Property) to the game, which is essentially everything that he created with Urban X Life. Even if none of the original art assets remained, he still owns everything from the name to the game, the characters, stories and whatever else he personally made in it (that means any 3rd party content naturally isn't his). So while creating a fan update isn't a problem per se, the problem arises when and if wootch comes back and if he doesn't like what he sees, he's liable to take legal action. I've took a look at the blog of guy you mentioned and he knows this full well too. But of course, I'm not a lawyer. I'm only talking about what I know, so if there's any lawyer out there and sees anything wrong with my statements, please correct me.
Now, my advice? Just make a new god damn game. Call it inspired by, or a parody of, or whatever of Urban X Life. Just make a. New. God. Damn. Game. I understand that there are many people who'd like to see this game continue to be developed, but there's too much legal issues tied into taking someone else's creation and attempting to continue it without the consent of the author. Seriously, just make a new game.
If I seem like I'm "taking wootch's side" by discouraging people from continuing his work because I don't want his work to be "stolen?" I'm not. I personally find Urban X Life to be rather badly designed. (If you need an example, just take a look at the controls. It's fucking atrocious. (And for the record, I'm not implying I'm fine with people's work being stolen. It's not okay.)) I just don't want to see anyone suffer the legal consequences should wootch choose to take action.
