How safe is LoK from a legal attack for using Krystal?

They generally only send a cease and desist if you are doing something that could infringe on their sales. From what I understand PokeNet was just an online Pokemon game, which of course could make people not purchase the ones Nintendo sells. I don't think that Nintendo is going to start selling side-scrolling porn games anytime soon...
